    Presentation Titled: Comparing preventive mechanisms in Australia and England and Wales: Preventive mechanisms are becoming increasingly common as governments across many jurisdictions seek to manage/mitigate risk and protect public safety. Operationalised through hybrid legal means, these powers offer policing bodies (and some non-law enforcement entities) the opportunity to control a range of behaviours using civil powers, with failure to comply resulting in criminal sanctions. These developments have important legal and human rights implications. Our work compares preventive mechanisms in two jurisdictions, Victoria, Australia, and England and Wales, to assess the rationale/reasoning for these powers, how they have been developed, and how they are being applied. Using hoon driving/car cruising as a focal point, and also acknowledging other key domains, we scrutinise policy making, risk assessment, governance, decision-making, discretion, and legitimacy to explore the consequences for individuals and communities.
